About the Role

 

Labor and Employment Counsel - México reports to Senior Manager, Labor and Employment Counsel – México.

This position is accountable for dealing with a variety of employment and labor-related legal matters, including oversight for strategic labor negotiations and trade union relationships, helping the Company comply with HR related legal requirements, providing strategic legal advice on various business initiatives, managing litigation files and the delivery of proactive HR legal training to Divisions/Groups. Providing guidance to facilitate decision-making in situations that involve labor matters, political, governmental, inspections by the authorities, strikes, work accidents and all kinds of issues related to lobbying on labor issues with authorities and business organizations, as well as the study and analysis of new regulations and their implementation in the company. Support on due diligences and internal labor audits. This position requires constant teamwork. with strategic vision to identify and anticipate labor problems and find solutions

Your Responsibilities

  • Provide legal advice respect to a wide variety of labor and employment matters, including compliance with Mexican Federal Labor Law, Social Security Law, Housing Fund and Pension Funds, and applicable Federal, State, or local laws dealing with labor and employment matters.   Draft and administer employment contracts, non-competition and confidentiality agreements, employee severance packages, executive compensation arrangements, voluntary exit, and early retirement initiatives.
  • Provide Corporate oversight role in a variety of labor litigation and regulatory matters before various state and federal Courts and administrative agencies, including the Federal Labor Board, Social Security Institute, and various Administrative Courts and Tribunals.
  • Draft and implement comprehensive workplace policies and procedures, working on documents such as the Employee Handbook, template employment contracts, local union contracts, template severance letters, etc.
  • Provide strategic advice on various corporate compliance functions, policies, investigations, and remedial action, including Hotline, Good Business Line and Enterprise Risk Management matters.
  • Advise on disability management and accommodation issues involving employees with disabilities.
  • Conduct wide variety of sensitive workplace investigations, and/or provide legal oversight for investigations being conducted by Company personnel or by third parties to maintain legal privilege.
  • Act as Labor Negotiator in union contract negotiations as requested by Divisions, while providing advice and interpretation of collective agreement language, and representing Groups and Divisions in grievances and arbitration related matters. And work on the implementation of the labor reform on unions, which is a full-time and permanent project due to the size of the operation in Mexico.

Who we are looking for

Education

  • Certified Attorney at Law.
  • LL.B. / J.D. or equivalent.

Work Experience

  • Minimum 5-6 years of experience working in an international law firm or legal department or international company with operations in Mexico or labor counsel. Specializing in HR and Labor Matters.
  • Experience in drafting and negotiating legal agreements, in both English and Spanish. and prepare labor legal opinions.
  • Significant litigation and negotiation experience.
  • Excellent computer skills, including with the necessary programs needed to perform the responsibilities as described (Word, Power Point, Excel, Outlook, and Teams).

Work Environment

  • Requires a moderate to extensive degree of travel to Divisions.
  • Occasional International travel required.
  • Willingness to work on location for reasonable periods of time.
